Kanpur: Arrest warrants have been issued by a Kanpur district court against individuals linked to Rimjhim Ispat and Juhi Alloys Ltd in a nearly 12-year-old case involving alleged tax evasion of ₹6.68 crore. The Special Chief Judicial Magistrate (Special CJM) court has directed the accused to be produced before the court by September 15. The Station House Officer of Sumerpur police station in Hamirpur has been instructed to ensure compliance with the court order.
The proceedings involve Rimjhim Ispat and Juhi Alloys Ltd along with Yogesh Agarwal, Mukul Agarwal, Kapil, Laxmikant Goyal and Anil Goyal. According to the prosecution, the case came to light in 2014 after the Directorate General of Goods and Services Tax Intelligence (DGGI) conducted searches at the company’s premises and allegedly detected tax evasion amounting to around ₹6.68 crore.
DGGI Conducted Searches in 2014
According to Special Public Prosecutor Ambrish Tandon, DGGI officials conducted searches at the Rimjhim Ispat factory and office in Bharua Sumerpur, Hamirpur, in 2014.
During the operation, officials examined business records and documents relating to the company’s financial and tax transactions. The investigation allegedly revealed tax liabilities amounting to approximately ₹6.68 crore.
Following the investigation, the prosecution filed a complaint before the court against the individuals associated with the companies. Yogesh Agarwal, Mukul Agarwal, Kapil, Laxmikant Goyal and Anil Goyal were among those named in the proceedings.
Accused Were Summoned by Court
During the initial stage of the judicial proceedings, the then Special CJM Harendra Bahadur Singh summoned the accused to appear before the court.
The accused subsequently sought relief through legal proceedings. A discharge application was also filed on their behalf. However, the then ACMM Gagan Kumar Bharti rejected the discharge plea.
Following the rejection, the accused approached the Allahabad High Court by filing a criminal revision petition challenging the lower court proceedings.
High Court and Supreme Court Provided No Relief
The criminal revision filed before the Allahabad High Court was heard and subsequently dismissed. The accused then approached the Supreme Court seeking further relief in the matter.
The Supreme Court also did not grant relief to the accused, allowing the proceedings before the lower court to continue.
With the higher courts declining to intervene in the matter, the case returned to the stage of further proceedings before the trial court.
Arrest Warrants Issued, September 15 Deadline
The Special CJM court has now issued arrest warrants against the accused and directed that they be produced before the court by September 15.
The court has specifically directed the Sumerpur police station in Hamirpur to ensure execution of the warrants and compliance with the order.
The police will now be responsible for locating the accused and producing them before the court in accordance with the judicial directions.
The latest order marks a fresh development in a case that has remained pending for more than a decade since the DGGI investigation began.
Prosecution to Rely on Tax Records
The next stage of the proceedings is expected to focus on documents and evidence collected during the DGGI investigation, including business records and material related to the alleged tax liability.
The prosecution will present its case before the court, while the accused will have the opportunity to contest the allegations through the judicial process.
The allegations remain subject to adjudication, and guilt will ultimately depend on the evidence and the court’s final decision. With the arrest warrants now issued after the accused failed to obtain relief from the higher courts, the long-pending tax case has entered another significant stage of legal proceedings.
