‘He’s Not a Terrorist’: Supreme Court Slams ED’s Midnight Arrest of Ex-IAS Officer

The Supreme Court has criticized the Enforcement Directorate (ED) for its “deplorable” actions in hastily arresting former IAS officer Anil Tuteja in connection with the Chhattisgarh liquor scam. The court questioned the urgency shown by the ED and demanded an explanation for registering a fresh case after its earlier proceedings were quashed.

The Supreme Court strongly condemned the Enforcement Directorate (ED) for what it described as a “tearing hurry” in arresting former IAS officer Anil Tuteja in connection with the Chhattisgarh liquor scam. The ED had registered a fresh case against Tuteja on April 11, just three days after the court had quashed its earlier proceedings.

Justice Abhay S. Oka, leading the bench, criticized the ED for arresting Tuteja late at night, stating, “This is deplorable. How can you arrest a person in the middle of the night? He was not a terrorist with bombs.”

The bench granted ED a day to justify the urgency in filing the second Enforcement Case Information Report (ECIR). The ED claimed the case involved Rs 2,000 crore in illegal profits earned by a syndicate of politicians, bureaucrats, and private individuals. Tuteja, allegedly a key player, was accused of facilitating bribes and unaccounted sales of liquor.

Advocates representing Tuteja argued that the new ECIR had no fresh evidence and relied on the same “reason to believe” as the first FIR, which had been quashed by the court. They labeled the ED’s actions as a deliberate attempt to bypass judicial orders.
