The Allahabad High Court has directed the Uttar Pradesh Bar Council to lodge First Information Reports against 105 advocates accused of securing their professional enrolment through fake educational qualifications. The court raised serious concerns over the credibility of the justice system and ordered criminal action under relevant provisions relating to fraud, forgery, impersonation, and other applicable offences. The court observed that if such practices are not checked in time, public confidence in the judicial system could be seriously undermined.
The significant directions were issued by a single-judge Bench of Justice Vinod Diwakar during the hearing of a petition filed by Mohammad Kafeel. During the court proceedings, records relating to advocate enrolment, pending criminal cases, and past disciplinary actions were placed before the bench, prompting immediate concern over the existing regulatory framework governing legal professionals in the state. The High Court observed that advocates are not merely representatives of their clients but are an integral part of the justice delivery system itself.
Concerns Over Criminal Cases in the Legal Profession
Data placed before the High Court revealed that the Uttar Pradesh Bar Council has more than 514,000 active registered advocates. Out of this total registration, 4,157 advocates are currently facing a total of 5,056 criminal cases. The records further indicate that 418 advocates have three or more criminal cases pending against them. Referring directly to these numbers, the court described the situation as deeply concerning and observed that it adversely affects the reputation of the entire legal profession.
In addition to ordering the initiation of criminal proceedings against the 105 advocates who allegedly obtained their enrolment using fake academic degrees, the court directed that appropriate legal action be taken against advocates who are already facing charge sheets in heinous criminal cases. The court emphasised that individuals entering the profession through fraudulent means or continuing legal practice despite facing serious criminal charges pose a direct threat to the credibility, fairness, and dignity of the judicial process.
Dissatisfaction with Bar Council Disciplinary Mechanisms
The High Court expressed strong dissatisfaction with the disciplinary mechanism of the Uttar Pradesh Bar Council, observing that timely and effective action was not being taken even in cases involving advocates accused of serious offences. The bench warned that any failure by regulatory bodies to discharge their statutory responsibilities could erode public trust in the justice system. The court added that maintaining the dignity, integrity, and transparency of the legal profession remains a shared responsibility of both the Bar Council and the judiciary.
Preserving public faith in judicial institutions requires that the process of entering and practising the legal profession remains strictly lawful, transparent, and accountable. The court indicated that the regulatory failures highlighted during the case demonstrate a clear need for stricter oversight and more aggressive enforcement of professional standards among active practitioners.
High Court Demands Comprehensive Reports from Authorities
Considering the overall seriousness of the matter, the High Court has sought detailed status reports from multiple state authorities. The court has directed the Director General of Police, the Director General of Prosecution, the Uttar Pradesh Bar Council, and the Registrar of Firms, Societies and Chits to submit comprehensive information regarding the current state of affairs.
These authorities must provide detailed updates on cases involving fake degrees, pending criminal proceedings against active advocates, disciplinary measures already taken, and specific steps proposed to prevent similar incidents from occurring in the future. The court order is being viewed as a significant step towards strengthening accountability within the legal profession and reinforcing public confidence in the justice delivery system by ensuring higher standards of professional integrity and regulatory oversight across the state.
