H-1B Visa Program Faces Major Changes, Picture Could Look Very Different in 365 Days

The Trump administration has signalled that the H-1B visa program could undergo significant changes over the next twelve months amid an expanding federal investigation into alleged foreign worker fraud, exploitation, and human trafficking. US Labor Department Inspector General Anthony D’Esposito stated in an interview that the foreign labor program may look substantially different 365 days from now. While he did not announce plans to abolish the visa route, his remarks underscore a period of intensified enforcement, corporate scrutiny, and potential regulatory shifts as investigators build a broader case regarding practices within the foreign labor system.

​Federal Probe Brings Subpoenas and Suspensions

​The Labor Department’s Office of Inspector General has accelerated a nationwide inquiry focusing on alleged abuses within employment visa channels. According to an official statement issued on September 18, investigators have served dozens of subpoenas and executed search warrants across the country. As part of the ongoing criminal inquiry, the department confirmed that visa applications associated with Cognizant and Cloudera have been suspended pending further investigation. D’Esposito noted that authorities intend to demonstrate real activity within the system rather than minor paperwork discrepancies, adding that the probe will require considerable resources and time to complete.

​Executive Order Mandates Review of Layoffs and Wages

​Parallel to the criminal inquiry, the White House has moved to heighten administrative scrutiny across the entire H-1B framework. A presidential executive order issued on September 18 directs the Departments of Labor, Homeland Security, and State to assess whether employers petitioning for foreign talent have recently laid off similarly situated American personnel. The directive also instructs the Wage and Hour Division to re-examine previously filed Labor Condition Applications, the foundational filings in which sponsoring firms declare prevailing wage levels and working conditions, to determine if enforcement measures are warranted against past filers.

​Entry Restrictions and Financial Thresholds Extended

​The administration has also extended existing entry restrictions on certain overseas H-1B recipients through September 21, 2027. Under this regulation, specific petitions filed for prospective employees currently outside the United States generally require an associated payment of $100,000, roughly equivalent to 84 lakh rupees, subject to select exemptions. Officials reported that earlier restrictions contributed to a 92 percent decline in H-1B registrations from major IT outsourcing providers alongside a sharp drop in consular processing requests. These evolving measures are drawing close attention from Indian technology professionals and outsourcing firms, for whom the visa remains a vital operational conduit, even as final long-term reforms to the program remain undecided.
