₹30,000 Crore Will Dispute Takes New Turn: Court Allows Forensic Examination of Sunjay Kapur’s Will

The dispute over the late industrialist Sunjay Kapur’s estate, valued at nearly ₹30,000 crore, has once again come into the spotlight after a significant judicial development. The Delhi High Court has permitted a forensic examination of the controversial will and granted Karisma Kapoor’s children and Sunjay Kapur’s mother, Rani Kapur, permission to inspect the original document. The disputed will is currently kept in a sealed cover with the court registry.

March 10 Inspection Scheduled

According to the court order, the inspection process has been scheduled for March 10 at 3:00 pm. During the inspection, Karisma Kapoor, Rani Kapur, and their authorised representatives may be accompanied by forensic or handwriting experts. The court has also directed that authorised counsel representing the other party must remain present during the process. If Priya Kapur’s counsel fails to appear, the side representing Karisma Kapoor and Rani Kapur will be allowed to proceed with the inspection.

However, the order clearly states that no photographs or copies of the original will shall be permitted during the inspection.

Arguments Over Original Document

During the hearing, counsel for Karisma Kapoor argued that although a copy of the will had already been shared earlier, examination of the original document was essential to verify its authenticity. The petitioners also sought permission for forensic analysis to help determine their future legal strategy regarding the estate dispute.

On the other hand, the plea was opposed by Priya Kapur’s legal team. They argued that such applications were not maintainable at this stage and that any request for forensic examination should be deferred until the evidence stage of the proceedings. It was also contended that the Joint Registrar did not have the jurisdiction to decide on the inspection request.

Court Rejects Confidentiality Claims

The court, however, rejected these submissions. The order observed that merely placing a document in a sealed cover does not automatically restrict the Registrar’s powers under the Delhi High Court Rules to permit inspection. The court further clarified that no specific judicial order had earlier been passed directing confidentiality of the will.

Family Estate Battle Continues

The will dispute has been at the centre of a long-running legal battle within the Kapur family. Karisma Kapoor’s two children and Sunjay Kapur’s mother have approached the High Court challenging the validity of the will, alleging inconsistencies in the document. It is claimed that the will allegedly transfers a major portion of the estate to Priya Kapur and her son, while the petitioners have raised concerns over possible irregularities in the document.

Attention now turns to the inspection scheduled for March 10, as all parties await the outcome of the process. Legal experts believe that permission for forensic examination could play a crucial role in shaping the future course of the case. However, the court has made it clear that no recording or copying of the document will be allowed during the inspection.

The property dispute involving the Kapur family has previously taken several legal turns. It is being speculated that the parties may decide their next legal strategy after the forensic examination of the will. For the moment, the matter will continue under judicial supervision, with further proceedings expected after the inspection process is completed.
