The technology sector in India, often celebrated for its innovation and growth, hides a darker reality beneath its glossy surface. A troubling nexus between Original Equipment Manufacturers (OEMs), vendors, and bureaucrats has created a web of corruption that threatens transparency and progress in the industry.

These essential tools, vital for combating cybercrime and ensuring national security, are being sold at inflated prices, sometimes marked up by 200% of their actual landing cost in India.

Different states and agencies are offered the same tools at wildly varying prices, exposing the lack of standardization in procurement practices.

Cartels in Indian Government Contracts
In India, cartels in government contracts have become a significant issue, particularly in the technological sector. These cartels typically involve a collaboration between Original Equipment Manufacturers (OEMs), their local representatives, and corrupt bureaucrats, who manipulate the procurement process to secure lucrative contracts.

The process begins with the rigging of tender specifications to favor specific vendors, often through the inclusion of non-essential technical requirements designed to exclude competition. This ensures that only pre-selected companies are able to bid successfully.

Once the contract is secured, price manipulation follows, with vendors inflating costs and charging the government far more than the actual market value of the products or services. In technological contracts, this malpractice is particularly harmful, as it involves critical infrastructure like cyber forensic tools, software, and cloud services.

The inflated costs are often hidden behind fake documentation, such as forged Manufacturer Authorization Forms (MAFs), and fake bidding companies that create an illusion of a competitive process. This cartelization not only drains public resources but also compromises the quality and efficiency of the services provided, undermining the integrity of India’s technological advancements.

The Deceptive Playbook of Corruption: Modus Operandi

  • The fraud begins with OEMs and their Indian partners manipulating tender specifications to favor pre-selected vendors.
  • Request for Proposals (RFPs) are crafted with arbitrary technical requirements designed to exclude competition, ensuring that contracts are awarded to a pre-determined entity.
  • To create the illusion of a fair bidding process, dummy companies are introduced as competitors, fulfilling the mandatory three-bid requirement while securing the contract for the intended party.
  • Once contracts are secured, vendors resort to rampant price manipulation.
    For example, digital forensic services outsourced to local vendors for as little as Rs 10,000–Rs 15,000 are billed to government agencies at nearly 20 times the cost.

Similarly, tools for mobile forensics, hard disk imaging, and internet forensics are sold at exorbitant prices. Evidence, including discrepancies on the government e-marketplace (GeM) portal and inflated purchase orders, reveals the extent of this malpractice.

Bureaucrats and Consultants: The Enablers

Corruption thrives with the active involvement of bureaucrats and consultants. Senior officials collude with vendors to draft project specifications that cater to specific OEMs. Technical committees, meant to ensure due diligence, often lack the expertise to challenge inflated costs or detect bid rigging.

Consultants acting as intermediaries further muddy the waters. Charging hefty fees of 5-10% of the project cost, they shield themselves from accountability while ensuring the contracts benefit their clients. When irregularities surface, government officials bear the brunt of scrutiny, while consultants and vendors escape unscathed.

A Wider Epidemic in Technology Procurement

The corruption extends beyond OEMs and vendors. Large corporations have been implicated in bid rigging, procurement fraud, and project manipulation across sectors such as transportation, agriculture, and IT. In the cybersecurity and cloud services domain, restrictive RFP clauses and exclusive partnerships inflate costs and compromise service quality, jeopardizing critical government and corporate projects.

3. Stronger Oversight: Empowering regulatory bodies and implementing stricter procurement guidelines will deter malpractices.
