Justice Shekhar Kumar Yadav of the Allahabad High Court stirred controversy during a recent event organized by the legal cell of the Vishwa Hindu Parishad (VHP) within the High Court premises. Addressing a gathering on the topic “Uniform Civil Code: A Constitutional Necessity,” Justice Yadav made remarks about India’s governance, community dynamics, and the importance of cultural identity.

In his speech, Justice Yadav stated, “India will function according to the wishes of the majority living here. This is the law. Only what ensures the welfare and happiness of the majority will be accepted.” He emphasized the importance of a majority-driven approach, comparing it to family dynamics where collective welfare is prioritized.

Justice Yadav used the term “kathmullah” to describe certain individuals, a term widely criticized as a slur against Muslims. He remarked on the necessity of vigilance against extremists and also commented on the upbringing of children in different communities, linking it to cultural practices.

On the Uniform Civil Code (UCC), he highlighted disparities between religious practices, asserting, “You can’t claim the right to have four wives, perform halala, or practice triple talaq. This right will not work. UCC isn’t something that VHP, RSS, or Hinduism alone advocates; it is a constitutional necessity.”

He also reflected on Hindu identity, stating, “Whether you are an advocate, a businessman, or a student, your identity as a Hindu comes first. Anyone who considers this land their mother and themselves as its child is a Hindu.” Justice Yadav called for respect towards Indian cultural symbols and stressed that maintaining the sanctity of laws like UCC was vital.

His remarks, including praise for the upcoming Ram Mandir in Ayodhya, have been viewed by many as a reflection of his ideological leanings. Critics have called for introspection about the appropriateness of such statements from a sitting judge. The judge has also come under heavy fire on social media platforms.

A user on X (formerly Twitter) expressed strong criticism, saying, “Judicial work ought to be withdrawn from Justice Shekhar Yadav of the Allahabad High Court immediately. And the fact that such an event was allowed to be held in the High Court premises is just another step in the erosion of institutions being led actively by those within.”
