Maninagar police have booked two builder brothers for allegedly selling a ₹1.10 crore shop without disclosing an outstanding loan.

How Did the Property Deal Take Place?

According to the complaint, businessman Rikesh Giteshbhai Mistry, a resident of Sitabag Society in Ahmedabad’s Maninagar area, decided to purchase Shop No. 10 on the ground floor of the Takshashila Crest project in 2024. The property, located opposite Pushkunj Society, was offered by builder Kamlesh Keshavbhai Gondaliya, an acquaintance of the complainant.

The transaction was finalised for ₹1.10 crore. Between January and August 2025, Mistry transferred the entire amount from his HDFC Bank account to Gondaliya’s Bank of India account through cheques and RTGS transactions. Following the payment, Kamlesh executed a registered sale deed in favour of the buyer on May 31, 2026.

How Was the Undisclosed Loan Discovered?

The alleged irregularities came to light on August 9, 2026, when Mistry visited the property and discovered that its shutter had been sealed by Aditya Birla Capital Finance. The action was reportedly linked to an unpaid project loan secured against the property.

Mistry subsequently contacted Kamlesh’s younger brother, Rajesh Gondaliya, who reportedly informed him that the loan process was underway. The buyer later received a no-objection certificate (NOC) from Kamlesh through WhatsApp. However, the document carried the name of Mistry’s father, Gitesh Jayantibhai Mistry, instead of the purchaser. It also showed a zero outstanding balance against an amount of ₹2,02,64,000, raising questions about its authenticity.

What Fraud Allegations Have Emerged?

According to the complaint, the builder brothers had allegedly obtained a project loan from Aditya Birla Capital Finance by pledging the property as security. However, the outstanding financial liability was not disclosed to Mistry before the sale was completed.

Despite receiving the full ₹1.10 crore consideration, the accused allegedly failed to clear the outstanding loan and instead used the money for personal purposes. They are also accused of preparing a forged NOC in the name of the buyer’s father to misrepresent the property’s financial status. These allegations form part of the police investigation and have not been established as proven offences.

What Action Have Police Taken?

Following Mistry’s complaint, Maninagar police registered a case against Kamlesh Gondaliya and Rajesh Gondaliya on allegations of cheating and criminal breach of trust. The complaint concerns the sale of a property allegedly carrying an undisclosed loan liability despite the buyer having paid the agreed amount and obtained a registered sale deed.

Police have initiated an investigation into the property transaction, the outstanding loan and the allegedly forged NOC. Investigators are examining the circumstances surrounding the sale and the financial representations made to the buyer. The case centres on allegations that the accused concealed an existing liability while transferring ownership of the shop, leaving the purchaser facing complications over a property for which he had already made full payment.
