Satellites in Space, Security Challenges on the Ground: Why Is India Cautious About Starlink?

NEW DELHI: Starlink’s push to secure commercial operating licences in India has brought national security considerations to the fore, with policymakers weighing the strategic risks of relying on a foreign-owned satellite constellation during armed conflicts or domestic emergencies. While Elon Musk’s satellite broadband venture awaits mandatory clearances, geopolitical developments abroad and domestic security incidents have heightened regulatory scrutiny over how private satellite networks can be monitored and controlled during crises.

​Manipur Recovery Prompts Security Review

​Concerns surrounding unauthorized satellite communications intensified following the recovery of Starlink equipment during an operation in Manipur’s Imphal East district in December 2024. Security forces seized a branded satellite dish and router in Keirao Khunou village marked with the letters ‘RPF/PLA’, an acronym tied to the banned People’s Liberation Army and its political wing, the Revolutionary People’s Front. The discovery prompted investigating agencies to evaluate whether insurgent groups could bypass terrestrial telecom suspensions, which authorities routinely enforce in conflict zones to maintain law and order.

​Forensic examinations subsequently indicated that the recovered hardware was non-functional, offering no evidence that insurgent factions had accessed Starlink’s satellite network within Indian territory. Starlink leadership also clarified that its satellite beams remained inactive over India. Even so, the incident underscored the challenges enforcement agencies face when monitoring low-earth-orbit equipment capable of delivering high-speed connectivity independently of domestic cellular towers.

​Ukraine Conflict Demonstrates Strategic Vulnerabilities

​The geopolitical debate over Starlink gained global prominence during the Russia-Ukraine war, where satellite broadband proved vital in sustaining Ukrainian civilian and military communications amid the destruction of traditional infrastructure. The network enabled real-time operational coordination and data transfer across frontline sectors where terrestrial links had collapsed.

​However, Ukraine’s experience also demonstrated the operational hazards of depending on an overseas private corporation. SpaceX made unilateral decisions regarding service limits, restricting Starlink’s functionality for offensive drone strikes and declining to activate coverage over Crimea in 2022. The episodes illustrated how a private operator’s corporate discretion could alter military maneuvers and restrict a sovereign nation’s strategic choices during wartime.

​Statutory Powers and Jurisdiction Limits

​Under Indian law, foreign satellite providers must secure rigorous security clearances before commercial launch. The government holds regulatory authority to mandate domestic gateway routing and ensure compliance with lawful interception frameworks. Furthermore, Sections 20 and 21 of the Telecommunications Act, 2023, grant the central government statutory authority to suspend services or assume operational control of telecommunications networks during public emergencies and national security threats.

​Enforcing regulatory authority over ground infrastructure, however, does not resolve the broader jurisdictional limits governing space assets. Under the Outer Space Treaty, the nation registering a satellite retains jurisdiction and control over the orbital vehicle itself. While Indian authorities can legally suspend operations or mandate ground station compliance within domestic borders, they hold no direct authority over global satellite constellations. As India balances connectivity expansion in remote territories with national defence requirements, maintaining resilient domestic networks and enforceable regulatory safeguards remains central to its security planning.
