Miami: Indian-origin real estate developer Rishi Kapoor has been sentenced by a US federal court to 11 years and four months in prison in a real estate fraud case involving nearly $89 million, or around ₹745 crore.

Kapoor, 41, pleaded guilty to charges related to money laundering and a conspiracy involving payroll taxes. The court has also imposed financial obligations, including restitution to investors, lenders and government agencies affected by the scheme.

Rishi Kapoor Sentenced in $89 Million Real Estate Fraud Case

According to US prosecutors, Kapoor raised nearly $89 million from investors between 2016 and 2023 by promising attractive returns from real estate projects.

Prosecutors alleged that a significant portion of the money was not used for the projects for which it had been raised. Instead, funds were allegedly diverted towards personal expenses and to keep his businesses operating.

Location Ventures Developer Rose to Prominence in South Florida

Kapoor was once regarded as a rising real estate developer in South Florida.

He served as chief executive of Location Ventures, whose projects included luxury residential and co-living developments in areas such as Coral Gables, Coconut Grove, Miami Beach and Fort Lauderdale.

Several projects were marketed to investors with promises of strong financial returns.

Investor Funds Allegedly Diverted From Real Estate Projects

Investigators alleged that Kapoor diverted money raised from investors instead of using it for the intended developments.

Prosecutors also accused him of falsifying bank statements to obtain credit. In addition, he allegedly misled escrow agents into releasing deposits paid by buyers for properties that had not yet been completed.

Several developments promoted by Kapoor were never completed, according to prosecutors.

₹19 Crore Yacht and Luxury Home Among Purchases

The US Department of Justice said Kapoor used money obtained from his business and investors to maintain an expensive lifestyle.

His purchases included a 68-foot yacht worth around ₹19.3 crore, a home in Cocoplum valued at approximately ₹10.9 crore, a Rolex Daytona watch and custom jewellery.

He also spent substantial amounts on international travel and other personal expenses, according to prosecutors.

Payroll Tax Scheme Involved Nearly ₹17 Crore

The case also involved a separate payroll tax scheme.

Kapoor’s company deducted income taxes and Social Security contributions from employees’ salaries but allegedly failed to remit around $2 million, or approximately ₹16.8 crore, to the US Internal Revenue Service.

Kapoor pleaded guilty in connection with the scheme as well. Prosecutors said the money was instead used to keep the company operating.

Prosecutors Accuse Developer of Misleading Banks and Investors

Federal prosecutors took a strong position against Kapoor during the court proceedings, alleging that he deceived banks, defrauded investors and used money deducted from employees to support his business and personal lifestyle.

Kapoor later entered into a plea agreement with prosecutors and admitted wrongdoing in the relevant charges.

Plea Agreement Reduced Scope of Criminal Charges

Kapoor initially faced several serious charges, including wire fraud and bank fraud, which could have resulted in a substantially longer prison sentence.

Under the subsequent plea agreement, he pleaded guilty to money laundering and payroll tax conspiracy charges.

Location Ventures Placed Under Receivership

In 2023, Kapoor’s company was placed into receivership following civil enforcement action by the US Securities and Exchange Commission.

Federal authorities are also pursuing the forfeiture of assets linked to Kapoor, including his yacht and real estate properties.

Proceeds from the sale of these assets are expected to be used, where applicable, to compensate victims.

Political and Business Connections Also Drew Attention

Kapoor’s business and political connections also attracted attention during the period when his company was operating.

His company hired former Miami Mayor Francis Suarez as a private consultant and reportedly paid him around ₹84 lakh per month. The arrangement raised questions over potential conflicts of interest.

However, the federal criminal case primarily focused on Kapoor’s alleged financial misconduct and the use of investor funds.

Authorities Continue Tracing Assets and Investor Money

Following the sentencing, authorities are continuing to focus on tracing the money raised from investors, identifying assets acquired with the proceeds and determining how much can be recovered for those affected by the scheme.

The case has also raised broader concerns over business practices used to attract large-scale investment in South Florida’s real estate market.
