Pune: A long-running dispute over Floor Space Index (FSI) rights attached to a property in Pune’s Kothrud area has taken a legal turn, with a real estate company and three of its officials facing allegations of cheating and fraudulent use of development rights worth nearly ₹50 crore. The complainant has alleged that FSI rights belonging to him were used in a development project despite an earlier agreement that they would be preserved, resulting in substantial financial losses.

2014 Agreement Under Scanner

The case has been registered following a complaint by a construction businessman, who claimed that when the property was sold in 2014, there was a clear understanding between the parties that the portion of FSI linked to his entitlement would not be utilized by the buyer. According to the complaint, although ownership of the land was transferred, certain development rights associated with the property were to remain protected.

The dispute relates to a property located near Ved Vihar in Kothrud, identified as Survey No. 77/1 (Part), Plot No. 1. The complainant has alleged that he held rights over approximately 1,753.62 square metres of FSI attached to the property. He claims that these development rights were subsequently used in a real estate project without safeguarding his entitlement.

FSI Rights Disputed

According to the complaint, assurances were repeatedly given over the years that the issue would be resolved. However, despite prolonged discussions and attempts to address the matter through administrative and legal channels, the dispute allegedly remained unresolved. The complainant has further alleged that representatives of the company denied using the disputed FSI during interactions related to the matter.

Three company officials have been named in the complaint. The businessman has claimed that the alleged utilization of the FSI resulted in financial losses estimated at around ₹50 crore. Based on these allegations, a cheating case has been registered and an investigation has been initiated.

Property Records Being Examined

Investigators are now examining a range of documents connected to the transaction, including property transfer records, development permissions, FSI utilization details, and contractual agreements executed between the parties. The objective of the investigation is to determine the exact terms of the original agreement and whether those conditions were adhered to during the subsequent development of the property.

Legal and real estate experts note that disputes involving FSI and development rights often involve complex contractual and regulatory issues. Such cases typically require a detailed examination of property records, planning approvals, and the wording of agreements to establish whether any rights were violated. If contractual breaches or unauthorized use of development rights are proven, the matter could have significant legal and financial consequences.

Investigation At Early Stage

The investigation remains at a preliminary stage, and authorities are currently engaged in verifying the relevant records and documents. No conclusions have been announced so far, and the allegations have not been independently established through judicial proceedings.

As the case progresses, investigators are expected to determine whether the disputed FSI was utilized in violation of the agreement and whether any fraudulent conduct or contractual breach occurred. The matter has once again highlighted the importance of transparency, clearly defined development rights, and meticulous documentation in real estate transactions.

The accused individuals and the company are presumed innocent unless and until proven guilty in a court of law.
