The Himachal Pradesh State Consumer Disputes Redressal Commission has directed an insurance company to compensate a client ₹13.36 lakh along with an annual interest of 9% for undue delay in settling a valid insurance claim.
The commission deemed the insurer’s conduct as a “deficiency in service” and a clear violation of policyholder rights under the Consumer Protection Act.

Policyholder’s Claim Denied Without Just Cause
The complainant, a resident of Shimla, had purchased an insurance policy for personal and property protection. Following a legitimate claim due to damage, the insured person approached the company for reimbursement as per the agreed policy terms.
Despite providing all the required documentation and fulfilling all procedural formalities, the complainant was made to wait for an unreasonably long time without resolution. The insurance company did not settle the claim and also failed to provide valid justification for the inordinate delay.
After months of silence and no redressal, the aggrieved policyholder filed a complaint with the Himachal Pradesh Consumer Forum seeking justice and compensation.

Tribunal Upholds Consumer’s Rights
In its verdict, the consumer commission not only ordered the company to release the ₹13.36 lakh insurance amount but also imposed an annual interest of 9% from the date of the original claim submission until final payment. The tribunal also recognized the mental agony and financial pressure faced by the complainant and cited this as a case of “unjustifiable harassment.”
The bench stated that insurance companies are legally bound to process genuine claims promptly and failing to do so constitutes a serious breach of contractual and ethical obligations.
The judgment serves as a warning to insurers against the practice of delaying claims without adequate reasons, which undermines consumer trust.
