NEW DELHI: The Securities and Exchange Board of India has barred Manish Kumar Dabkara, founder and managing director of EKI Energy Services Ltd, from accessing the securities market for one year and slapped a financial penalty of Rs 28 lakh on him. The regulatory intervention comes after an extensive investigation uncovered alleged misrepresentation in the financial statements of the carbon credit trading firm, alongside the unauthorized diversion of corporate funds.

Regulatory Directives Mandate Recovery of Diverted Funds

In an official order passed on October 30, the market regulator instructed Dabkara to take immediate measures to recover the capital allegedly diverted from the firm. Alongside the twelve-month ban on securities transactions, the regulator penalized Dabkara with a Rs 28 lakh fine to enforce personal accountability. The decision underlines the watchdog’s intent to pair access restrictions with direct corrective demands, preventing corporate promoters from evading financial liabilities.

The enforcement order also penalizes seven other individuals linked to the carbon market intermediary, including three former executive directors. These executives were handed staggered market bans ranging from one month to eight months, tailored to their individual levels of involvement in the bookkeeping irregularities and fund management breaches. Financial penalties were also levied against the remaining individuals subject to the proceedings.

Scrutiny Mounts Over Climate Solutions Provider

EKI Energy Services operates primarily within the carbon credit trading space and the wider climate solutions market. The firm facilitates the purchase and sale of carbon credits, which correspond to verified reductions or removals of greenhouse gas emissions utilized by corporations to meet environmental commitments. Due to the high-growth profile and investment interest surrounding the emerging carbon offset sector, the company’s financial health, disclosures, and ledger allocations underwent strict oversight by the market regulator.

The investigation centered on reconciling the firm’s balance sheets with actual cash flows, which exposed systemic discrepancies. By directing Dabkara to pursue the recovery of the diverted sums without delay, the watchdog highlighted that corporate officers cannot bypass disclosure norms or deploy corporate balances outside authorized channels, especially when dealing with market-facing instruments.

Broad Crackdown on Governance and Capital Markets Reporting

The disciplinary measures reflect an intensifying regulatory campaign aimed at tightening governance benchmarks and ensuring absolute reporting accuracy among listed and market-linked companies. Disciplinary restrictions barring primary figures from capital trading function as a core safeguard, preserving investor confidence and curbing administrative abuses across business entities.

Transparent ledger maintenance remains critical for institutional and retail investors seeking to evaluate balance sheet liabilities, core income streams, and genuine business prospects. Manipulated accounts or opaque asset transfers distort investment appraisals and damage institutional credibility across modern capital markets. The action serves as an unambiguous warning that senior management and founding promoters will confront statutory liability, personal financial penalties, and market exclusions for accounting improprieties.
